Terms of Service

Terms for the DarkWatch monitoring service provided by Tendor IT.

1. Scope

Tendor IT provides monitoring of publicly available sources (ransomware leak sites, dark web marketplaces, public Telegram channels) for the domains, brands and keywords agreed with the customer. Findings are indicators, not verified facts, and do not constitute a guarantee that an incident has or has not occurred.

2. Customer obligations

The customer confirms that it is authorised to monitor the submitted domains, brands and keywords and that the data is used for lawful security purposes only. Requests that cannot be verified are rejected.

3. No guarantee of completeness

Dark web sources are volatile. Tendor IT does not guarantee complete detection of all incidents, leaks or listings. Reports reflect the state of the sources at the time of collection.

4. Fees and term

Fees are stated in EUR per month, excluding statutory VAT. The contract runs monthly and can be cancelled at the end of the billing month unless otherwise agreed.

5. Liability

Tendor IT is liable without limitation for intent and gross negligence. For slight negligence, liability is limited to foreseeable damage typical for this type of contract. Liability for third-party claims arising from the content of monitored sources is excluded.

6. Governing law

German law applies. For merchants, the place of jurisdiction is Regensburg.
